Klemens Strasser’s Privacy and Data Policy

1. General

1.1 I, Klemens Strasser (“I” or “me”), am an Einzelunternehmer (sole trader) registered in Austria in the field of “Dienstleistungen in der automatischen Datenverarbeitung und Informationstechnik”, with a business address at Prangelgasse 1, 8020 Graz, Austria. My email address is support@strasser.app.

1.2 I take your personal data very seriously and am vigilant with regard to its protection. With this Privacy and Data Policy (briefly “Policy”), I would therefore like to inform you of the purposes for which and how I collect and process your data (including your personal data), when you use my game “Art of Fauna: Cozy Puzzles+” (briefly “Game”), which is available on Apple Arcade. This Policy applies and has effect in respect of this Game.

1.3 The Game handles data from individuals under the age of 13, or the equivalent minimum age in the relevant jurisdiction, in the same way as for other users, as described in this Policy, for the purpose of fulfilling my contractual obligations arising from you playing the Game (for details on that legal foundation, please see Article 6 (1) lit b GDPR). If you wish data of individuals under the age of 13 to be deleted, please contact me at the contact information set out in item 1.1 above. The Game is not directed at children under the age of 13. If I discover that I have inadvertently collected personal information from a child under 13, I will take reasonable steps to promptly delete such information.

1.4 Should you have any questions or comments about this Policy, or should you wish to exercise your rights as a “data subject” (for details on those rights, please see item 5 below), please contact me at the contact information set out in item 1.1 above.

1.5 I may make changes to this Policy from time to time, which will be made available here. I encourage you to check here for any such changes from time to time, so you remain fully informed about my data processing activities pertaining to the Game.

2. Data Processing Activities

2.1 Game Progress and Achievements

2.1.1 The Game stores information about your progress in the Game — specifically, which puzzles you have played and completed (briefly “Game Progress”). The Game also tracks achievements you have obtained through Apple Game Center.

2.1.2 The purpose of storing Game Progress is solely to provide the Game to you, including to remember your progress across sessions and across your devices. I do not use this data for any other purpose.

If you do not provide Game Progress data, you may still play the Game, but your progress will not be saved and you will not be able to obtain achievements.

2.1.3 Game Progress is stored on services provided by Apple: on Apple’s iCloud for puzzle progress and on Apple’s Game Center for achievements. I do not store your personal data or Game Progress on my own servers. Accordingly, Apple’s privacy policies for iCloud and Game Center apply to the storage and handling of this data.

You may decline to store data in Apple’s iCloud or to send data to Apple’s Game Center:

• To turn off iCloud data storage for the Game, you must disable iCloud for the Game in your Apple device’s Settings. As a result, your progress will only be saved locally on the device you are currently using, and you will not be able to load your progress on another device.
• To stop sending data to Apple’s Game Center, you must sign out of Apple’s Game Center in your Apple device’s Settings. As a result, you will not be able to obtain any achievements in the Game.

2.1.4 To learn how Apple’s iCloud and Apple’s Game Center process your personal data, please refer to Apple’s privacy policies:

2.1.5 Except for the Game Progress described above, the Game does not collect any further data from you or your device(s). This does not apply to data you choose to share yourself via the social sharing features described in item 2.3 below.

2.2 Contact Inquiries

2.2.1 If you contact me with a question, bug report, or other inquiry (for example via email), I will process the contact information you provide, such as your name and email address, for the purpose of responding to your inquiry (for details on that legal foundation, please see Article 6 (1) lit b GDPR).

2.2.2 If you do not provide at least one contact detail, such as an email address, I will unfortunately be unable to respond to your inquiry.

2.2.3 In order to handle contact inquiries, I work with the following service provider (“Processor”) who processes your personal data on my behalf and for my purposes, but not for their own purposes:

2.3 Social Sharing

2.3.1 The Game allows you to share a puzzle image upon completing a puzzle, or when revisiting a completed puzzle from the menu. Two sharing options are available:

• Instagram Story: Tapping this button will open the Instagram app directly and pre-populate a Story with the puzzle image. Tapping this button opens the Instagram app via a deep link and passes the puzzle image to it. From that point, everything that happens with the image is within Instagram’s platform and governed by Instagram’s own privacy policy, available at https://privacycenter.instagram.com/policy. I have no control over, and am not responsible for, how Instagram handles your data once the app is opened.
• Other: Tapping this button invokes iOS’s standard system share sheet, allowing you to send content to social media platforms, messaging apps, or other destinations of your choosing. Any data collected as a result is governed solely by the privacy policy of the platform or app you share to.

2.4.2 I do not transmit any data in connection with either sharing option. Both options are entirely optional and have no effect on your ability to play the Game.

2.4 Discord

2.4.1 The Game contains a link to an external Discord server. Tapping this link will navigate you away from the Game and to Discord, a third-party platform operated by Discord Inc. Once you leave the Game, this Policy no longer applies. Any data you provide on Discord — including any information collected simply by visiting — is governed solely by Discord’s own privacy policy, available at https://discord.com/privacy. I have no control over, and am not responsible for, Discord’s data collection or processing practices.

2.4.2 Following the Discord link is entirely optional and has no effect on your ability to play the Game.

3. Data Sharing

3.1 I do not share any of your personal data with third parties for their own purposes.

3.2 With regard to Game Progress stored on Apple’s iCloud and Apple’s Game Center, please see items 2.1.3 and 2.1.4 above. Apple receives data about your game play as part of providing these services.

3.3 I may also share data if required to do so by law, or if necessary to comply with a subpoena, court order, or other legal process.

4. Data Retention

4.1 I do not retain personal data longer than necessary for the purpose for which it was collected. Game Progress is stored in your personal iCloud account and persists independently of whether the Game is installed on your device — it is not deleted upon uninstalling the Game. This data resides within your own iCloud account and is outside of my control. You can manage or delete it via iOS Settings under your iCloud account.

4.2 Contact inquiry data is retained only for as long as necessary to resolve the inquiry. Once a support case has been fully processed, the associated personal data is deleted.

5. Your Rights as a “Data Subject”

5.1 As a person concerned under data protection laws (briefly “Data Subject”), you have the following rights vis-à-vis me as the controller:

1. Right to Information (Article 15 GDPR): You have the right to obtain confirmation as to whether personal data concerning you is being processed, and if so, to receive access to that data and information about it.
2. Right to Rectification and Erasure (Articles 16–17 GDPR): You have the right to request the correction of inaccurate personal data and, under certain circumstances, the deletion of your personal data.
3. Right to Restriction of Processing (Article 18 GDPR): You have the right to request that the processing of your personal data be restricted under certain circumstances.
4. Right to Data Portability (Article 20 GDPR): Where processing is based on consent or a contract and carried out by automated means, you have the right to receive your personal data in a structured, commonly used, and machine-readable format.
5. Right to Object (Article 21 GDPR): You have the right to object to the processing of your personal data under certain circumstances.
6. Right to File a Complaint with a Supervisory Authority: You have the right to file a complaint with a supervisory authority, in particular in the EU Member State of your residence, your workplace, or the place of the alleged infringement.
